SB13 HFAT SHOTT 2-2 

            Delegate Shott moves to amend the title of the bill to read as follows:

 S.B. 13--“A Bill to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §55-7-27, relating to the liability of a possessor of real property for injuries caused by open and obvious hazards; reinstating and codifying open and obvious doctrine of common law as it existed prior to judicial abolition; providing that the open and obvious doctrine of common law does not apply when a dangerous condition is a violation of a public safety statute or ordinance which violation is the proximate cause of injury; clarifying that this section does not create, recognize or ratify a claim or cause of action; and stating legislative intent.”
